Judicial or any Courts. . . the Punjab Legislative Council may order the Governor of the Punjab to lay down these rules which include rules relating to the repeal of existing laws, amendments of the laws in force and also of any of the rules or regulations or any of the laws made by this Act. As a result, the Punjab Legislative Council passed the Code of Punjabi Criminal Procedure to the Governor of the Punjab, giving the Governor the power to rule on whether or not the Code came in conflict with any other law. This shows clearly that the Governor of the Punjab, in making rules, acted in accordance with the provisions of the Charter Act of 1833, which empowered the Governor of the Punjab to make laws in the Punjab. It must be noted that the Code of Criminal Procedure does not contain any provision in relation to penal provisions. Accordingly, the penal provisions were made by the Governor of the Punjab in the Code of Criminal Procedure which was passed in 1875. These penal provisions have now been incorporated in the Code of Criminal Procedure, 1911, which has been in force since the year 1911. 12. As regards the penal provisions of the Code of Criminal Procedure, 1911, it has been observed that it is based on the Code of Criminal Procedure, 1873, although with certain changes made in those penal provisions which formed an integral part of the Code of Criminal Procedure, 1873. It is fairly submitted that the Code of Criminal Procedure, 1873, was the first attempt made to codify the criminal law and was prepared by the erstwhile Punjab Criminal Code Drafting Committee under the Chairmanship of Pandit Raghuvir Lal, an eminent jurist. The Punjab Criminal Code, 1873, was amended in 1875, 1908, 1912 and 1919. The Penal Code as such was only introduced in 1911 and contained the penal provisions which were known as the Penal Code of 1911, and which still continue to be the penal law in force in the Punjab
